Terms of Service

1. About this service

Nelkins Properties (“Nelkins”, “we”, “us”) provides a software platform for real-estate brokers operating in Dubai and the broader UAE. By creating an account or accessing the service you accept these terms.

2. Eligibility

You must be at least 18 years old, hold a valid Dubai broker registration number (BRN) where required for licensed activity, and be authorised to act on behalf of any brokerage you represent in the platform.

3. Plans, trials and billing

  • The free plan is offered indefinitely subject to fair-use limits shown in-product.
  • Paid plans (Pro, Team) are billed monthly in advance via Stripe. Annual plans, when offered, are billed up-front and renew annually unless cancelled.
  • New accounts that sign up directly may be eligible for launch promotional pricing (currently 30% off Pro for the first two months). Promotional pricing is applied at checkout and is not combinable with other offers.
  • The 30-day Pro trial is one per account. Cancelling before the trial ends prevents any charge.
  • You can cancel at any time from Settings. Cancellation takes effect at the end of the current billing period; we do not pro-rate refunds for partial months.

4. Your content and data

You retain all rights to the contacts, listings, messages and documents you store in the platform. You grant Nelkins a limited licence to host, process and display this content solely for the purpose of operating the service for you. We do not sell your content or use it to train models for other customers.

5. Acceptable use

You must not use the service to:

  • send unsolicited bulk messages outside the consent boundaries of WhatsApp Business and applicable spam laws;
  • upload content that infringes a third party's rights or violates RERA / DLD regulations;
  • reverse-engineer, resell, or sub-licence the platform; or
  • attempt to access another tenant's data.

6. Service availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance and emergency security patches may cause downtime. We will not be liable for losses caused by unavailability beyond the fees you have paid in the prior 12 months.

7. Termination

We may suspend or terminate accounts that materially breach these terms, with notice where reasonable. On termination you may export your data for up to 30 days, after which it may be permanently deleted.

8. Liability

To the maximum extent permitted by law, Nelkins is not liable for indirect, incidental or consequential losses including lost profits, lost commissions or lost data. Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim.

9. Governing law

These terms are governed by the laws of the Dubai International Financial Centre (DIFC). Disputes will be resolved in the DIFC Courts unless another forum is mandated by applicable law.

10. Changes

We may update these terms. Material changes will be notified by email or in-product at least 14 days before they take effect.
